Effective date: September 30, 2026
These Terms of Service (“Terms”) govern access to and use of the CFSsign websites, applications, and services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms. If you use the Service for an organization, you represent that you have authority to bind that organization.
1. Eligibility and accounts
You must be legally capable of entering into a binding agreement and provide accurate account information. You are responsible for protecting account credentials and for activity under your account. Notify support@cfssign.com promptly if you suspect unauthorized access.
2. The Service
CFSsign provides tools to upload, prepare, send, review, sign, and track electronic documents. Features may change as we improve the Service. Your right to use the Service is limited, nonexclusive, nontransferable, and subject to these Terms and any applicable order or written agreement.
3. Electronic transactions
You and your signing participants are responsible for determining whether electronic signatures are appropriate for a transaction and for complying with applicable notice, consent, identity, retention, and other legal requirements. CFSsign provides technology and transaction records but does not provide legal advice or guarantee that a particular document or signature will be enforceable in every jurisdiction or circumstance.
4. Customer content
You retain your rights in documents, data, and other material submitted to the Service (“Customer Content”). You grant CFSsign the limited rights necessary to host, process, transmit, display, and back up Customer Content to provide, secure, and support the Service. You represent that you have the rights and permissions needed to submit Customer Content and direct its processing.
5. Recipient communications
You may send transactional messages only to recipients with whom you have a legitimate relationship or valid reason to transact. You may not use CFSsign for unsolicited marketing, purchased lists, deceptive messages, or unlawful communications. You are responsible for recipient information and message content you provide.
6. Acceptable use
You must comply with our Acceptable Use Policy. You may not interfere with the Service, attempt unauthorized access, introduce malicious code, misuse another person’s identity, or use the Service to violate law or third-party rights.
7. Privacy and security
Our Privacy Policy describes how we process personal information. We maintain safeguards designed to protect the Service, but you remain responsible for configuring workflows appropriately, limiting access, maintaining endpoint security, and downloading or retaining copies needed for your records.
8. Third-party services
The Service may rely on or connect with third-party services. Their terms and privacy practices govern their services. We are not responsible for third-party products or services that we do not control.
9. Suspension and termination
We may suspend or limit access when reasonably necessary to protect the Service or its users, address a security risk, comply with law, prevent abuse, or respond to a material breach. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.
10. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” ESIGNER DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SUITABLE FOR EVERY LEGAL TRANSACTION.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESIGNER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES. ESIGNER’S AGGREGATE LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED THE AMOUNT PAID FOR THE SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED U.S. DOLLARS IF NO FEES WERE PAID.
12. Indemnification
You agree to defend and indemnify CFSsign from third-party claims arising from your Customer Content, your use of the Service in violation of these Terms, or your violation of law or third-party rights, except to the extent caused by CFSsign’s own misconduct.
13. Governing law
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules. The state and federal courts located in Gwinnett County, Georgia will have exclusive jurisdiction, unless applicable law requires otherwise.
14. Changes and contact
We may update these Terms and will post the revised version with a new effective date. Material changes may be communicated through the Service or by email. Questions may be sent to legal@cfssign.com or CFSsign, 6621 Bay Circle, Suite 190, Peachtree Corners, GA 30071, USA.
